PASS Policy on Work Clearance for HIV+ Talent
HIV+ talent who have an undetectable viral load are able to safely have sex without any risk of viral transmission. However, HIV+ talent are unable to be cleared in the PASS database regardless of their viral load due to compliance with disclosure laws. These guidelines have been created for productions involving HIV+ talent so the crew can acquire and interpret the necessary documentation.

PASS recommends that all the following requirements be met by HIV+ talent prior to sexual performance or contact*:
Non-Reactive Standard PASS Panel within the last 14 days.
HIV NAAT-PCR clearance showing a viral load under 200 copies/ml
A clinician’s note documenting that the talent is currently durably undetectable.
‘Durably undetectable’ means they have maintained a viral load of under 200 copies/ml for at least six months since their initial positive result.
Talent may choose to provide clinical documentation to PASS, who may certify that the talent has met this criteria upon request (regardless of talent’s availability in the PASS database).
Clinical certification will only be provided to parties that have been authorized by the talent.
Disclosure of HIV status to potential sexual partners prior to any activity as required by law.
*This should include any type of sexual contact, even in instances in which there is virtually no risk of infection, due to potential legal liability.
